Effective date: September, 2026
These terms govern your use of the Zerqith website and applications provided by Zerqith.com, at Mangalore, IN (“Zerqith”, “we”, “us”). Contact [email protected]. These website terms apply to use of this site. App or paid-service terms are presented through the applicable installation, purchase or acceptance process. If you act for a business, you confirm that you have authority to bind it. If you do not agree, do not use the service.
1. Scope and platform terms
Our product pages and documentation describe particular features. Features vary by product, installed release and plan. An applicable order or separately signed agreement takes precedence over these general terms where it expressly conflicts. Shopify and other third-party platforms have their own terms; you must comply with them. A reference to a platform does not imply endorsement or a partnership beyond any relationship actually disclosed.
2. Eligibility and account security
You must be legally capable of entering the agreement and authorized to administer any store or account involved. Keep access permissions and contact details accurate, protect credentials and promptly report suspected unauthorized access. You are responsible for activity you authorize, but this does not exclude our responsibility where applicable law provides otherwise. Grant only the permissions necessary for the agreed workflow.
3. Permission to use the service
Subject to these terms and payment of applicable fees, we grant a limited, non-exclusive, non-transferable right to use the service for the personal or business purposes permitted by the relevant product offer during the applicable service period. We retain rights in our software, documentation, designs and branding, except for rights expressly granted. Third-party/open-source components remain subject to their own licenses; nothing here overrides those licenses.
4. Your content and configuration
You retain rights in content you supply. You grant us the rights reasonably necessary to host, process, display and transmit that content to deliver the service and carry out your instructions. You are responsible for its accuracy, lawful use, intellectual-property permissions and required notices. Do not put sensitive customer information into public blocks or fields not designed for it. Keep suitable copies of important configuration and business records.
5. Acceptable use
Do not use the service unlawfully, mislead shoppers, infringe rights, distribute malicious code, interfere with other users, evade plan limits or security controls, obtain unauthorized access, or attempt to extract another merchant’s information. Reverse engineering is restricted only to the extent permitted by applicable law and relevant licenses. Do not use promotional templates to publish unsubstantiated ratings, false scarcity or invalid discount claims.
6. Product-specific responsibilities
Tile Calculator provides estimates based on entered dimensions, units, packaging and allowances. You must verify specifications and whether one cart quantity represents one box. Estimates do not guarantee suitability, coverage, installation outcomes or compliance with building requirements. Obtain appropriate professional advice for project-specific decisions.
Flexi Blocks displays merchant-controlled content and promotions. You must verify links, discount eligibility, scheduling, localization and statements shown to shoppers. Copying a coupon code does not create a platform discount. Evergreen timers must not be presented misleadingly as a fixed universal deadline.
Test changes in an appropriate preview or duplicate theme before publishing. Theme changes, platform updates and other apps can affect behavior.
7. Fees, subscriptions and taxes
The current purchase or subscription screen states applicable fees, billing intervals, trial conditions and plan entitlements. We do not create a charge merely by publishing a price-free guide. Where Shopify bills a subscription, Shopify’s approval and billing mechanisms apply. You are responsible for applicable taxes and platform charges stated at purchase.
An upgrade, downgrade or cancellation takes effect according to the offer, platform rules and mandatory law. A downgrade can reduce features or product allowances; review any displayed grace period and update configuration accordingly. We will give notice of fee changes as required by the agreement, platform and law. See billing and refunds.
8. Cancellation and refunds
Cancel or uninstall through the platform’s applicable controls. Removing a theme block alone may not cancel a subscription. Check the platform’s billing record after cancellation. Refund eligibility depends on the purchase terms, applicable platform process, the circumstances and mandatory consumer/business protections. Contact support with the shop domain and charge reference; do not send card details. These terms do not remove statutory cancellation or refund rights.
9. Availability, changes and support
We may update features, fix defects or modify integrations. We aim to avoid unnecessary disruption but do not promise uninterrupted availability or compatibility with every theme or third-party extension. Support and service levels are those expressly included in your agreement. Where a material change or discontinuation affects a paid commitment, we will provide the notice and remedies required by the agreement and applicable law.
Contact messages
Submitting an enquiry does not place an order, create a paid subscription or guarantee a response time. A delivery acknowledgement means the message was accepted by our mail service; it does not mean that a support agent has read it. Do not submit unlawful content or confidential material that is not needed to resolve your request. Contact-form information is handled as described in the privacy policy. Ownership of your correspondence remains with you.
10. Suspension and termination
We may restrict or suspend access where reasonably necessary for security, nonpayment, legal compliance or a material breach. Where practicable, we will give notice and an opportunity to resolve the issue. We may act immediately when delay would create material harm or violate law. Either party may terminate as allowed by the applicable agreement and law. After termination, the right to use the service ends; data handling follows the privacy policy and any applicable processing agreement. Terms intended to survive, including accrued payment obligations and applicable liability provisions, continue to apply.
11. Privacy and confidentiality
Our privacy policy explains personal-information handling. You must provide storefront disclosures and obtain permissions required for your chosen configuration. If either party receives the other’s nonpublic business information through support or service delivery, it must use reasonable care and use it only for the relevant service, except where disclosure is authorized, independently lawful or legally required.
12. Warranties and limitations
To the extent permitted by applicable law, services are provided on an “as available” basis without implied warranties of merchantability, fitness for a particular purpose or non-infringement beyond those that cannot lawfully be excluded. We do not warrant that an estimate, promotion or integration will meet every business requirement. Any express written warranty or mandatory legal protection remains effective.
To the extent permitted by law, neither party is liable to the other for indirect or consequential losses, lost profits or loss of business arising from the service. Our aggregate liability under these terms is limited to fees you paid us for the affected service during the twelve months preceding the event giving rise to the claim. This limit does not apply to liability that cannot lawfully be limited, including fraud, intentional misconduct or applicable mandatory statutory rights. The scope and enforceability of exclusions depend on the governing law.
13. Third-party services
Links, app stores, external fonts, hosting platforms and other integrations are operated by third parties under their own terms and policies. You are responsible for deciding whether a merchant-selected integration is suitable. We remain responsible for our own obligations and do not exclude obligations merely because a provider is involved.
14. Disputes
For any disputes, please contact [email protected] so we can attempt to resolve the issue.
15. General Provisions and Changes
If a provision is unenforceable, the remaining provisions will continue. Failure to enforce a provision does not constitute a waiver. We may update these terms from time to time.
We may revise these terms and will update the effective date. Contact Zerqith.com, Mangalore, IN, or [email protected] for questions.
